1. ACCEPTANCE AND CONSENT

By clicking “I Accept” or by downloading, installing, or using the Game, you signify your agreement to these Terms of Service and our Privacy Policy (https://dreampotiongames.com/privacypolicy.html) including the collection of anonymous usage data through Firebase Analytics and the serving of advertisements via Google AdMob, as outlined therein.

Consent for Personalized Advertising:

European Economic Area (EEA) and the United Kingdom (UK): For users located in the EEA and the UK, consent for the use of personalized advertisements served by AdMob is obtained separately through Google's User Messaging Platform (UMP) SDK, in accordance with applicable data protection regulations.
Other Regions (Aged 13 and Over): For users aged 13 and over located in regions outside the EEA and the UK, your consent to the use of personalized advertisements by AdMob is provided as part of your agreement to these Terms and our Privacy Policy. You have the ability to manage your ad preferences and opt out of personalized advertising as described in Section 6 of these Terms and our Privacy Policy.

By proceeding to use the Game, you acknowledge that you have read and understood how data is collected and used, including for advertising purposes, as detailed in these Terms and our Privacy Policy.

2. AGE REQUIREMENT

Mago: Dashing Star! is intended for users aged 13 and over, as determined by the user’s Google Play account settings. We do not knowingly collect personal information from children under 13, in compliance with the Children’s Online Privacy Protection Act (COPPA) and other laws. Please refer to our Privacy Policy for more detail (https://dreampotiongames.com/privacypolicy.html).

3. ACCOUNTS AND DATA

Google Play Account Required: Access to and use of Mago: Dashing Star! requires an active and logged-in Google Play account.
Internet Connection: A stable internet connection is necessary to play the Game and access all its features, including saving game progress.
Cloud Saving via Google Play Games: Your game progress is automatically saved and synchronized through Google Play Games cloud services.
Deleting Cloud Save Data: To delete your game progress and associated cloud save data for Mago: Dashing Star!, you will need to access the Google Play Games app on your device and manage the saved data for this specific game within its settings. Dream Potion Games does not directly manage or have the ability to delete your Google Play Games cloud save data. Please refer to the Google Play Games app for instructions on how to delete game data.
No Responsibility for Save Issues Due to Connection Instability: Dream Potion Games is not responsible for any loss of game progress or inability to save data that results from an unstable, intermittent, or absent internet connection. Cloud saving functionality is dependent on the reliability of the user's internet service and the Google Play Games services. While the Game attempts to save progress, a poor connection may lead to data loss or unsaved progress, and this is outside of our direct control.
No Direct Personal Data from Purchases: We do not receive any personally identifiable information from you related to in-app purchases made through the Google Play Store. All transaction details are managed and processed by Google Play in accordance with their policies.

4. LICENSE

4.1 Grant:

We grant you a personal, non-transferable, revocable license to play the Game for non-commercial entertainment purposes only, subject to these Terms. You acknowledge that the Game requires an internet connection for certain functionalities, including saving progress and accessing all features. We are not responsible for issues arising from unstable or absent internet connectivity, including potential loss of progress.

4.2 Restrictions:

You are strictly prohibited from:

Reverse-engineering, decompiling, disassembling, modifying, or creating derivative works of the Game, except to the extent expressly permitted by applicable law.
Distributing, renting, leasing, selling, transferring, or commercially exploiting the Game or any of its parts, including but not limited to virtual currency (Premium Orbs) and virtual items.
Using or distributing unauthorized software, cheats, exploits, or hacks, or otherwise circumventing security measures implemented in the Game.

Regarding Virtual Currency and Items: The Game may include virtual currency ("Premium Orbs") and virtual in-game items. These digital assets are licensed to you for use within the Game only. You acknowledge that you do not own these virtual items or currency and have no right to transfer, sell, or trade them outside of the Game's intended mechanics, if any are provided. We reserve all rights to manage, modify, or remove virtual currency and items within the Game at our sole discretion, as further detailed in Section 2 (Ownership).

4.3 Updates:

We may deploy mandatory updates to the Game to ensure proper functionality, security, and the delivery of new content. By continuing to use the Game after an update is deployed, you signify your acceptance of the updated version of the Game and these Terms as they may be modified by such updates.

4.4 Ad-Gated Content:

Certain optional in-game features or content (e.g., bonus levels) may be unlocked by viewing advertisements served by Google AdMob (subject to their policies). These features are optional and their availability may be modified or removed at our sole discretion. We will endeavor to provide reasonable notice of significant changes to or the removal of such features. Your continued use of the Game after such changes constitutes your acceptance. If you do not agree with such changes, your sole remedy is to cease using the Game. We do not guarantee that rewards will be granted if advertisements fail to load or complete, and an active internet connection is required for this feature.

5. IN-GAME PURCHASES

The Game offers opportunities to enhance your gameplay experience through in-app purchases available via Google Play Billing, which is managed and processed by Google Play and subject to the Google Play Terms of Service. These purchases include:

Premium Mode (Ad-Removal Pass): A one-time purchase that grants you unlimited lives within the Game, eliminating the need to watch advertisements to replenish lives. Purchasing the Premium Mode also removes interstitial advertisements from the Game.
Premium Orbs: A virtual currency that can be purchased in various amounts. These Orbs can be used within the Game to acquire cosmetic items such as character costumes, gameplay enhancements, and other virtual objects to personalize and improve your in-game experience. The availability and types of items purchasable with Premium Orbs are subject to change at our sole discretion.
All purchases are final, and refunds are subject to the Google Play Store refund policies. While Dream Potion Games does not directly process refunds, users experiencing issues with their purchases should first consult the Google Play Store support. Dream Potion Games may review refund requests on a case-by-case basis for issues directly attributable to the Game and may provide assistance in accordance with applicable laws and our internal policies.

As all transactions are processed by Google Play, we only receive confirmation of the transaction, including the item purchased, the price, and the date of the transaction, as well as an anonymous order ID. We do not have access to your email address or any payment details.

Parents and guardians are encouraged to utilize the parental control settings available in the Google Play Store to manage and restrict in-app purchases on their devices. These can be accessed through the Google Play Store settings or Family Link (https://play.google.com/about/families/).

6. ADVERTISING

You acknowledge and agree that Mago: Dashing Star! may feature advertisements served by us and third-party advertising partners, including Google AdMob. By using the Game, you understand that:

We may display advertisements within the Game, and the format, frequency, and placement of such advertisements may be modified at our sole discretion.
We are not responsible for the content of any third-party advertisements displayed in the Game, nor for the content of any external websites or materials linked within those advertisements. You interact with such third-party content at your own risk.
As detailed in our Privacy Policy (https://dreampotiongames.com/privacypolicy.html), we may provide certain non-personal information to our advertising partners to help deliver relevant advertisements and measure their effectiveness.
You may have options to manage your advertising preferences or opt-out of personalized advertising through your device settings, as further explained in our Privacy Policy.
Certain optional in-game features may be offered in exchange for viewing advertisements, as described in Section 4.4.
You can opt out of personalized ads via your device settings (Android: Settings → Google → Ads → Opt out of Ads Personalization), which will result in non-personalized ads.

7. OWNERSHIP

All rights, title, and interest in and to the Game, including but not limited to its code, software, graphics, artwork, user interfaces, audio, music, visual content, characters, names, virtual currency (Premium Orbs), virtual items, and all other content, are owned by or licensed to Dream Potion Games and are protected by applicable intellectual property laws. You acknowledge that you receive no ownership rights in or to any part of the Game or its content, including any virtual currency or virtual items, regardless of whether you have "earned" or "purchased" them. These virtual assets are for your entertainment within the Game only and have no real-world monetary value. Dream Potion Games has the absolute right to manage, regulate, control, modify, and/or eliminate such virtual currency and/or virtual items at any time, with or without notice, and shall have no liability to you or any third party for the exercise of such rights.

8. PRIVACY

Dream Potion Games is committed to protecting your privacy. This Game utilizes third-party services (as detailed in these Terms) that may collect certain data. By using the Game, you acknowledge that you have read and understood our Privacy Policy.

9. DISCLAIMERS

9.1 "AS IS" and "AS AVAILABLE" Basis:

THE GAME IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING OUT OF COURSE OF DEALING OR USAGE OF TRADE. DREAM POTION GAMES DOES NOT WARRANT THAT THE GAME WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

9.2 Limitation of Liability:

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, DREAM POTION GAMES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES (INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES) ARISING OUT OF OR RELATING TO YOUR ACCESS TO OR USE OF, OR YOUR INABILITY TO ACCESS OR USE, THE GAME. THIS INCLUDES, BUT IS NOT LIMITED TO, LOSS OR CORRUPTION OF GAME PROGRESS, DATA, VIRTUAL CURRENCY, OR VIRTUAL ITEMS, AS WELL AS ERRORS OR PERFORMANCE ISSUES.

9.3 Specific Exclusions of Liability:

WITHOUT LIMITING THE GENERALITY OF THE FOREGOING, YOU ACKNOWLEDGE AND AGREE THAT DREAM POTION GAMES SHALL NOT BE LIABLE FOR ANY LOSS OR DAMAGE ARISING FROM:

Lack of a stable internet connection.
Device malfunctions (hardware or software failures).
Errors or issues caused by your actions (e.g., abrupt app closure, failure to sync data).
External factors beyond our reasonable control (e.g., server outages of third-party services, platform issues).
Issues with third-party advertisements displayed in the Game.
Device compatibility problems, especially if your device does not meet the Minimum Technical Requirements specified in Section 14.

You understand and agree that game progress in Mago: Dashing Star! is exclusively saved and synchronized through Google Play Games cloud saving services. Maintaining a stable internet connection is crucial for ensuring that your progress is saved correctly. Dream Potion Games is not responsible for any loss of game progress resulting from an unstable, intermittent, or absent internet connection, as this is a condition necessary for the cloud saving functionality provided by Google Play Games.

Therefore, you are responsible for ensuring a stable internet connection during gameplay to prevent potential loss of progress. Dream Potion Games does not provide any local saving options on your device.

10. TERMINATION

We reserve the right to suspend or terminate your license to use the Game and your access to it at any time, with or without cause and without prior notice. Reasons for termination may include, but are not limited to, your breach of these Terms.

Upon termination, your right to access and use the Game will immediately cease. You are required to uninstall the Game from all devices on which it is installed.

The following sections of these Terms, as well as any provisions that by their nature are intended to survive termination, shall continue in effect after your license and access to the Game are terminated:

Unless explicitly required by applicable law, no refunds will be provided for any unused virtual currency, virtual items, or any other in-app purchases in the event of termination of your license or access to the Game. We may consider refund requests for paid purchases (e.g., Ad-Removal Pass) on a case-by-case basis, as required by applicable consumer protection laws.

11. GOVERNING LAW AND DISPUTE RESOLUTION

These Terms shall be governed by and construed in accordance with the laws of Peru, without regard to its conflict of law principles. Any dispute, controversy, or claim arising out of or relating to these Terms or the Game shall be subject to the exclusive jurisdiction of the courts of Lima, Peru.

To the fullest extent permitted by Peruvian applicable law, you agree to waive any right to participate in a collective action lawsuit (acción colectiva) with respect to any claim arising out of or relating to these Terms or the Game. You acknowledge that you may only bring claims against Dream Potion Games in your individual capacity.

12. CHANGES TO TERMS

Dream Potion Games reserves the right to modify, amend, or update these Terms of Service and our Privacy Policy at any time in our sole discretion. We will provide notice of material changes to these Terms by posting the updated Terms on our website (www.dreampotiongames.com) with an updated “Last Updated” date or through in-game notifications.

Your continued use of the Game after the effective date of any changes constitutes your acceptance of the updated Terms and/or Privacy Policy. If you do not agree with the changes, you may stop using the Game and uninstall it.

13. DATA DELETION

Please be aware that your game progress and cloud save data are managed by Google Play Games. To delete this information, you will need to use the Google Play Games app or visit Google's Privacy Portal: https://privacy.google.com/take-control.html. If you require assistance with this process, you can also email us at contact@dreampotiongames.com.

14. MINIMUM TECHNICAL REQUIREMENTS

To ensure optimal performance of the Game, your mobile device must meet the following minimum technical specifications: MINIMUM OPERATING SYSTEM VERSION ANDROID 12, MINIMUM RAM 4GB, MINIMUM PROCESSOR OCTA-CORE 1.8 GHZ, MINIMUM FREE STORAGE SPACE 1GB. These requirements ensure full functionality, including gameplay, advertisements, and cloud saving. Devices below these specifications may experience issues. We do not guarantee that the Game will function correctly or at all on devices that do not meet these requirements. It is your responsibility to ensure your device meets these specifications before downloading and continuing to use the Game.

15. SEVERABILITY

If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it valid, legal, and enforceable, and the remaining provisions of these Terms shall continue in full force and effect.

16. COPYRIGHT AND USER-GENERATED CONTENT

16.1 Intellectual Property:

All rights, title, and interest in and to the Game, including but not limited to its software, code, graphics, text, sounds, music, videos, and other content, are owned by or licensed to Dream Potion Games and are protected by applicable intellectual property laws. You acknowledge that you have no ownership rights in the Game or any of its content.

16.2 User-Generated Content License:

If you share any content related to the Game, such as screenshots or videos ("User Content"), you grant Dream Potion Games a non-exclusive, worldwide, royalty-free, perpetual, irrevocable, transferable, sub-licensable license to use, reproduce, distribute, modify, create derivative works of, publicly display, and publicly perform such User Content in connection with the Game and our business, including for promotional and marketing purposes, in any media formats and through any media channels. You represent and warrant that you have all necessary rights to grant us this license. You may request removal of your User Content from our promotional materials by emailing contact@dreampotiongames.com, and we will comply within 30 days, provided the content is not already in public circulation.

16.3 Use by Content Creators and Streamers:

Dream Potion Games permits content creators and streamers to create and share audiovisual content based on the Game for non-commercial purposes, provided they: (a) provide appropriate attribution to the Game and Dream Potion Games; (b) do not use the content for third-party marketing without our prior written consent; and (c) comply with these Terms, including the rules regarding prohibited conduct. Dream Potion Games reserves the right to request the removal of any content that we deem to be in violation of these Terms or harmful to the Game or our reputation.

17. ENTIRE AGREEMENT

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Dream Potion Games with respect to the Game and supersede all prior or contemporaneous communications and proposals, whether oral or written, between you and Dream Potion Games.

Estos activos digitales se le conceden bajo licencia para su uso únicamente dentro del Juego. Usted reconoce que no posee estos artículos o moneda virtuales y no tiene derecho a transferirlos, venderlos o comerciar con ellos fuera de los mecanismos previstos del Juego, si los hubiera. Nos reservamos todos los derechos para gestionar, modificar o eliminar la moneda virtual y los artículos dentro del Juego a nuestra entera discreción, según se detalla en la Sección 2 (Propiedad).

4.4 Contenido con Publicidad Obligatoria:

Ciertas características o contenido opcionales dentro del juego (por ejemplo, niveles de bonificación) pueden desbloquearse al ver anuncios servidos por Google AdMob (sujeto a sus políticas). Estas características son opcionales y su disponibilidad puede ser modificada o eliminada a nuestra entera discreción. Nos esforzaremos por proporcionar un aviso razonable de cambios significativos o la eliminación de dichas características. 5. COMPRAS DENTRO DEL JUEGO

El Juego ofrece oportunidades para mejorar su experiencia de juego a través de compras dentro de la aplicación disponibles a través de Google Play Billing, que es gestionado y procesado por Google Play y está sujeto a los Términos de Servicio de Google Play. Estas compras incluyen:

Modo Premium (Pase de Eliminación de Anuncios): Una compra única que le otorga vidas ilimitadas dentro del Juego, eliminando la necesidad de ver anuncios para reponer vidas. La compra del Modo Premium también elimina los anuncios intersticiales del Juego.
Orbes Premium: Una moneda virtual que se puede comprar en varias cantidades. Estos Orbes se pueden usar dentro del Juego para adquirir elementos cosméticos como disfraces de personajes, mejoras de juego y otros objetos virtuales para personalizar y mejorar su experiencia dentro del juego. La disponibilidad y los tipos de elementos que se pueden comprar con Orbes Premium están sujetos a cambio a nuestra entera discreción.
Todas las compras son finales, y los reembolsos están sujetos a las políticas de reembolso de Google Play Store. Aunque Dream Potion Games no procesa directamente los reembolsos, los usuarios que experimenten problemas con sus compras deben consultar primero el soporte de Google Play Store. Dream Potion Games puede revisar las solicitudes de reembolso caso por caso para problemas directamente atribuibles al Juego y puede proporcionar asistencia de acuerdo con las leyes aplicables y nuestras políticas internas.

Usted reconoce y acepta que Mago: Dashing Star! puede incluir anuncios servidos por nosotros y por socios publicitarios de terceros, incluyendo Google AdMob. Al utilizar el Juego, usted comprende que:

Podemos mostrar anuncios dentro del Juego, y el formato, la frecuencia y la ubicación de dichos anuncios pueden ser modificados a nuestra entera discreción.
No somos responsables del contenido de ningún anuncio de terceros mostrado en el Juego, ni del contenido de ningún sitio web externo o material enlazado dentro de esos anuncios. Usted interactúa con dicho contenido de terceros bajo su propio riesgo.
Según se detalla en nuestra Política de Privacidad (https://dreampotiongames.com/privacypolicy.html), podemos proporcionar cierta información no personal a nuestros socios publicitarios para ayudar a entregar anuncios relevantes y medir su efectividad.
Usted puede tener opciones para gestionar sus preferencias de publicidad u optar por no recibir publicidad personalizada a través de la configuración de su dispositivo, según se explica en nuestra Política de Privacidad.
Ciertas características opcionales dentro del juego pueden ofrecerse a cambio de ver anuncios, según se describe en la Sección 4.4.

Usted reconoce que no adquiere ningún derecho de propiedad sobre ninguna parte del Juego o su contenido, incluida cualquier moneda virtual o elementos virtuales, independientemente de si los ha "ganado" o "comprado". Estos activos virtuales son únicamente para su entretenimiento dentro del Juego y no tienen valor monetario en el mundo real. EL JUEGO SE PROPORCIONA "TAL CUAL" Y "SEGÚN DISPONIBILIDAD", SIN GARANTÍAS DE NINGÚN TIPO, EXPRESAS O IMPLÍCITAS, INCLUYENDO, ENTRE OTRAS, GARANTÍAS DE COMERCIABILIDAD, IDONEIDAD PARA UN PROPÓSITO PARTICULAR, NO INFRACCIÓN Y CUALQUIER GARANTÍA QUE SURJA DEL CURSO DE NEGOCIACIÓN O USO COMERCIAL. DREAM POTION GAMES NO GARANTIZA QUE EL JUEGO SERÁ ININTERRUMPIDO, LIBRE DE ERRORES O SEGURO.

9.2 Limitación de Responsabilidad:

EN LA MEDIDA MÁXIMA PERMITIDA POR LA LEY APLICABLE, DREAM POTION GAMES NO SERÁ RESPONSABLE DE NINGÚN DAÑO INDIRECTO, INCIDENTAL, ESPECIAL, CONSECUENCIAL O PUNITIVO (INCLUYENDO, SIN LIMITACIÓN, DAÑOS POR PÉRDIDA DE BENEFICIOS, DATOS, USO, FONDO DE COMERCIO U OTRAS PÉRDIDAS INTANGIBLES) QUE SURJAN DE O ESTÉN RELACIONADOS CON SU ACCESO O USO DEL JUEGO, O SU INCAPACIDAD PARA ACCEDER O USARLO. ESTO INCLUYE, PERO NO SE LIMITA A, LA PÉRDIDA O CORRUPCIÓN DEL PROGRESO DEL JUEGO, DATOS, MONEDA VIRTUAL O ARTÍCULOS VIRTUALES, ASÍ COMO ERRORES O PROBLEMAS DE RENDIMIENTO.

9.3 Exclusiones Específicas de Responsabilidad:

SIN LIMITAR LA GENERALIDAD DE LO ANTERIOR, USTED RECONOCE Y ACEPTA QUE DREAM POTION GAMES NO SERÁ RESPONSABLE DE NINGUNA PÉRDIDA O DAÑO QUE SURJA DE:

Falta de una conexión a internet estable.
Fallos del dispositivo (fallos de hardware o software).
Errores o problemas causados por sus acciones (por ejemplo, cierre abrupto de la aplicación, falta de sincronización de datos).
Factores externos fuera de nuestro control razonable (por ejemplo, interrupciones del servidor de servicios de terceros, problemas de plataforma).
Problemas con los anuncios de terceros mostrados en el Juego.
Problemas de compatibilidad del dispositivo, especialmente si su dispositivo no cumple con los Requisitos Técnicos Mínimos especificados en la Sección 14.

Usted comprende y acepta que el progreso del juego en Mago: Dashing Star! se guarda y sincroniza exclusivamente a través de los servicios de guardado en la nube de Google Play Games. Mantener una conexión a internet estable es crucial para asegurar que su progreso se guarde correctamente. Dream Potion Games no es responsable de ninguna pérdida de progreso del juego que resulte de una conexión a internet inestable, intermitente o ausente, ya que esta es una condición necesaria para la funcionalidad de guardado en la nube proporcionada por Google Play Games.

Por lo tanto, usted es responsable de garantizar una conexión a internet estable durante el juego para evitar la posible pérdida de progreso. Dream Potion Games no proporciona ninguna opción de guardado local en su dispositivo.

10. TERMINACIÓN

Nos reservamos el derecho de suspender o terminar su licencia para usar el Juego y su acceso a él en cualquier momento, con o sin causa y sin previo aviso. Las razones para la terminación pueden incluir, entre otras, su incumplimiento de estos Términos.

Tras la terminación, su derecho a acceder y usar el Juego cesará inmediatamente. Se le solicitará que desinstale el Juego de todos los dispositivos en los que esté instalado.

Las siguientes secciones de estos Términos, así como cualquier disposición que por su naturaleza deba sobrevivir a la terminación, continuarán en vigor después de la terminación de su licencia y acceso al Juego:

Sección 15 (Divisibilidad)

A menos que lo exija explícitamente la ley aplicable, no se proporcionarán reembolsos por cualquier moneda virtual no utilizada, artículos virtuales o cualquier otra compra dentro de la aplicación en caso de terminación de su licencia o acceso al Juego. Podemos considerar las solicitudes de reembolso para compras pagadas (por ejemplo, Pase de Eliminación de Anuncios) caso por caso, según lo exijan las leyes de protección al consumidor aplicables.

11. LEY APLICABLE Y RESOLUCIÓN DE DISPUTAS

Estos Términos se regirán e interpretarán de acuerdo con las leyes de Perú, sin tener en cuenta sus principios de conflicto de leyes. Cualquier disputa, controversia o reclamo que surja de o esté relacionado con estos Términos o el Juego estará sujeto a la jurisdicción exclusiva de los tribunales de Lima, Perú.

En la máxima medida permitida por la ley peruana aplicable, usted acepta renunciar a cualquier derecho a participar en una demanda colectiva (acción colectiva) con respecto a cualquier reclamo que surja de o esté relacionado con estos Términos o el Juego. Usted reconoce que solo puede presentar reclamos contra Dream Potion Games a título individual.

12. CAMBIOS EN LOS TÉRMINOS

Dream Potion Games se reserva el derecho de modificar, enmendar o actualizar estos Términos de Servicio y nuestra Política de Privacidad en cualquier momento a nuestra entera discreción. Notificaremos los cambios sustanciales a estos Términos publicando los Términos actualizados en nuestro sitio web (www.dreampotiongames.com) con una fecha de "Última Actualización" modificada o a través de notificaciones dentro del juego.

14. REQUISITOS TÉCNICOS MÍNIMOS

Para garantizar el rendimiento óptimo del Juego, su dispositivo móvil debe cumplir con las siguientes especificaciones técnicas mínimas: VERSIÓN MÍNIMA DEL SISTEMA OPERATIVO ANDROID 12, MÍNIMO DE RAM 4GB, PROCESADOR MÍNIMO OCTA-CORE 1.8 GHZ, ESPACIO DE ALMACENAMIENTO LIBRE MÍNIMO 1GB. Estos requisitos garantizan la plena funcionalidad, incluyendo el juego, los anuncios y el guardado en la nube. Los dispositivos por debajo de estas especificaciones pueden experimentar problemas. No garantizamos que el Juego funcione correctamente o en absoluto en dispositivos que no cumplan con estos requisitos. Es su responsabilidad asegurarse de que su dispositivo cumple con estas especificaciones antes de descargar y continuar utilizando el Juego.

15. DIVISIBILIDAD

Si alguna disposición de estos Términos se considera inválida, ilegal o inaplicable por un tribunal de jurisdicción competente, dicha disposición se modificará en la medida mínima necesaria para que sea válida, legal y aplicable, y las demás disposiciones de estos Términos continuarán en pleno vigor y efecto.

16. DERECHOS DE AUTOR Y CONTENIDO GENERADO POR EL USUARIO

16.1 Propiedad Intelectual:

Todos los derechos, títulos e intereses sobre el Juego, incluyendo, entre otros, su software, código, gráficos, texto, sonidos, música, videos y demás contenido, son propiedad de Dream Potion Games o están licenciados a Dream Potion Games y están protegidos por las leyes de propiedad intelectual aplicables. Usted reconoce que no tiene derechos de propiedad sobre el Juego ni sobre ninguno de sus contenidos.

16.2 Licencia de Contenido Generado por el Usuario:

Si usted comparte cualquier contenido relacionado con el Juego, como capturas de pantalla o videos ("Contenido del Usuario"), usted otorga a Dream Potion Games una licencia no exclusiva, mundial, libre de regalías, perpetua, irrevocable, transferible y sublicenciable para usar, reproducir, distribuir, modificar, crear obras derivadas de, mostrar públicamente y ejecutar públicamente dicho Contenido del Usuario en relación con el Juego y nuestro negocio, incluso para fines promocionales y de marketing, en cualquier formato de medios y a través de cualquier canal de medios. Usted declara y garantiza que tiene todos los derechos necesarios para otorgarnos esta licencia. Puede solicitar la eliminación de su Contenido de Usuario de nuestros materiales promocionales enviando un correo electrónico a contact@dreampotiongames.com, y lo cumpliremos dentro de los 30 días, siempre que el contenido no esté ya en circulación pública.

16.3 Uso por Creadores de Contenido y Streamers:

Dream Potion Games permite a los creadores de contenido y streamers crear y compartir contenido audiovisual basado en el Juego con fines no comerciales, siempre que: (a) proporcionen la atribución adecuada al Juego y a Dream Potion Games; (b) no utilicen el contenido para marketing de terceros sin nuestro consentimiento previo por escrito; y (c) cumplan con estos Términos, incluidas las reglas sobre conducta prohibida. Dream Potion Games se reserva el derecho de solicitar la eliminación de cualquier contenido que consideremos que infringe estos Términos o que es perjudicial para el Juego o nuestra reputación.

17. ACUERDO COMPLETO

Estos Términos, junto con nuestra Política de Privacidad, constituyen el acuerdo completo entre usted y Dream Potion Games con respecto al Juego y reemplazan todas las comunicaciones y propuestas anteriores o contemporáneas, ya sean orales o escritas, entre usted y Dream Potion Games.
