This End User License Agreement (hereinafter referred to as the "EULA") is a legally binding agreement between you, the user (hereinafter referred to as the "User"), and Dream Potion Games S.A.C. (hereinafter referred to as “ Dream Potion Games ”, “we”, “us” or “our”) for the use of the software called Super Mago Dashing Star (hereinafter referred to as the "Game"). By downloading, installing, accessing or using the Game, you agree to be bound by the terms and conditions of this EULA. If you do not agree to these terms, please refrain from installing or using the Game.

1. PURPOSE OF THE AGREEMENT

1.1. Limited License Grant

Dream Potion Games grants you a revocable, limited, non-exclusive, non-transferable, non-sublicensable license to download, install and use the Game on a device that you own for your personal, non-commercial use. The Game is licensed, not sold; therefore, this EULA grants you no title or ownership rights in the Game or its contents.

1.2. Scope and Restrictions of the License

This license grants you limited rights of use and does not imply any transfer of any ownership rights in the Game. You are not authorized to, directly or indirectly:

(a) Modify, decompile, reverse engineer, disassemble or otherwise attempt to discover the source code of the Game, except as expressly permitted by applicable law;

(b) Reproduce, distribute, rent, lease, sell, resell, sublicense or transfer the Game

(d) Create derivative works, translations, adaptations, or alternative versions of the Game.

1.3. Game Updates and Modifications

Dream Potion Games may, at its sole discretion, implement updates, patches, modifications or improvements to the Game at any time. You acknowledge and agree that such modifications may be made without prior notice and may be necessary for the proper functioning of the Game. Your continued use of the Game constitutes your acceptance of such updates or modifications.

2. INTELLECTUAL PROPERTY AND COPYRIGHT

2.1. Game Ownership

All rights, title and interest in and to the Game, including, but not limited to, any content, code, design, user interface, text, graphics, software, music and sounds (collectively, the "Game Content"), are the exclusive property of Dream Potion Games or its licensors. The Game is protected by international copyright and other intellectual property laws and treaties.

2.2. Third Party Trademarks and Content

Any trademarks, logos, designs, or third party content appearing in the Game are the property of their respective owners. Their inclusion in the Game does not imply the grant of any additional license or rights in such content. The use of third party content without the express permission of the owner is prohibited.

2.3. User Generated Content

In the event that the Game allows for the creation of content (such as comments, reviews, images, or any other type of material), you automatically grant Dream Potion Games a perpetual, irrevocable, non-exclusive, sublicensable, transferable, royalty-free license to use, reproduce, modify, distribute and display such content in connection with the Game. Dream Potion Games may use any such user-generated content in marketing campaigns, promotional materials, or other communications related to the Game.

3. PRIVACY AND DATA PROTECTION

3.1. Data Collection

Dream Potion Games does not collect or store personal data directly through the Game. Any purchase information or other personal data that may be required to access the Game is handled exclusively by the distribution platforms (Google Play Store) in accordance with their own privacy and data management policies.

3.2. Third Party Policies

Access and use of the Game through third-party platforms may be subject to the privacy policies and terms of service of such platforms, which may be different from those of Dream Potion Games .

4. WARRANTIES AND LIMITATIONS

4.1. Exclusion of Warranties

THE GAME IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR CONTINUOUS AVAILABILITY OF THE GAME.

4.2. Limitation of Liability

To the maximum extent permitted by law, Dream Potion Games shall not be liable for any direct, indirect, incidental, special, punitive or consequential damages, including but not limited to loss of data, revenue, use, goodwill or any other intangible losses arising out of the use or inability to use the Game, even if Dream Potion Games has been advised of the possibility of such damages.

4.3. Disclaimer of Warranties for Game Performance

Dream Potion Games does not warrant that the Game will be error-free, free of security vulnerabilities, interruptions, or that it will operate without delays. You acknowledge that access to and use of the Game may be interrupted by circumstances beyond the control of Dream Potion Games .

5. SECURITY AND ANTI-CHEATING

Dream Potion Games reserves the right to implement technological protection measures to ensure the security of the Game and the integrity of the gaming experience. The use of third-party software, cheats, hacks or any other method that alters or modifies the original functionality of the Game is strictly prohibited. Any attempt at unauthorized manipulation, interference or modification will constitute a breach of this EULA and will result in the termination of your license, without prejudice to any further legal action that Dream Potion Games may deem necessary.

6. REVERSE ENGINEERING BAN

You may not reverse engineer, decompile, disassemble or otherwise attempt to discover the source code of the Game, in whole or in part. This provision applies except to the extent such activities are expressly permitted by applicable law, and only after notifying Dream Potion Games in writing of such actions.

7. PROHIBITION OF ACCOUNT TRANSFERS

You are strictly prohibited from selling, transferring, renting, sublicensing or assigning your user account or rights to use the Game to any third party, whether by contract, assignment or otherwise. Any attempted transfer or disposal without express permission from Dream Potion Games will constitute a breach of this EULA and will result in immediate revocation of the license.

8. TERMINATION

8.1. Termination of EULA

Dream Potion Games reserves the right to terminate this EULA and your access to the Game if you breach any term or condition set forth herein. Upon termination of this agreement, you shall permanently delete all copies of the Game from your devices.

8.2. Effects of Termination

Termination of this EULA does not limit Dream Potion Games' rights to seek any remedies available at law for breach. The provisions of Intellectual Property, Limitation of Liability, Dispute Resolution, and any other provisions which by their nature should survive termination shall survive termination.

9. DISPUTE RESOLUTION

For any dispute arising from the use of the Game , THE PARTIES agree to waive their right to take legal action before a court and submit to arbitration at the WIPO Arbitration and Mediation Center , waiving the right to class action lawsuits.

Choosing to resolve disputes through the WIPO Arbitration Center demonstrates our commitment to fair, efficient and neutral dispute resolution. We value the trust that users place in our services and strive to maintain a transparent and collaborative relationship in the event of any conflict.

The arbitration award shall be binding and final.

10. MODIFICATIONS TO THE EULA

Dream Potion Games reserves the right to modify the terms of this EULA at any time. Modifications will be notified through a posting on the official Dream Potion Games website or through the Game itself. Your continued use of the Game constitutes your acceptance of the modifications made.

11. DIVISIBILITY

If any provision of this EULA is found to be unlawful, void or unenforceable, such provision will be limited or eliminated to the minimum extent necessary to comply with applicable law, and the remaining provisions will remain in full force and effect.

Este Acuerdo de Licencia de Usuario Final (en adelante, el "EULA") es un acuerdo legalmente vinculante entre usted, el usuario (en adelante, el "Usuario"), y Dream Potion Games S.A.C. (en adelante, “ Dream Potion Games ”, “nosotros” o “nuestro”) para el uso del software denominado Super Mago Dashing Star (en adelante, el "Juego"). Al descargar, instalar, acceder o utilizar el Juego, usted acepta someterse a los términos y condiciones de este EULA. Si no está de acuerdo con estos términos, absténgase de instalar o utilizar el Juego.

1. OBJETO DEL ACUERDO

1.1. Concesión de Licencia Limitada

Dream Potion Games le otorga una licencia revocable, limitada, no exclusiva, intransferible y no sublicenciable para descargar, instalar y utilizar el Juego en un dispositivo de su propiedad para su uso personal y no comercial. El Juego se licencia, no se vende; por lo tanto, el presente EULA no le otorga derechos de titularidad ni de propiedad sobre el Juego ni sobre sus contenidos.

1.2. Alcance y Restricciones de la Licencia

Esta licencia le otorga derechos limitados de uso y no implica transferencia de ningún derecho de propiedad sobre el Juego. Usted no está autorizado para, directa o indirectamente:

(a) Modificar, descompilar, realizar ingeniería inversa, desensamblar o intentar descubrir el código fuente del Juego, excepto en los casos permitidos expresamente por la ley aplicable;

(b) Reproducir, distribuir, alquilar, arrendar, vender, revender, sublicenciar o transferir el Juego

(d) Crear trabajos derivados, traducciones, adaptaciones, o versiones alternativas del Juego.

1.3. Actualizaciones y Modificaciones del Juego

Dream Potion Games puede, a su exclusiva discreción, implementar actualizaciones, parches, modificaciones o mejoras en el Juego en cualquier momento. Usted reconoce y acepta que estas modificaciones pueden realizarse sin previo aviso y pueden ser necesarias para el correcto funcionamiento del Juego. La continuidad en el uso del Juego constituye su aceptación de dichas actualizaciones o modificaciones.

2. PROPIEDAD INTELECTUAL Y DERECHOS DE AUTOR

2.1. Propiedad del Juego

Todos los derechos, títulos e intereses sobre el Juego, incluidos, entre otros, cualquier contenido, código, diseño, interfaz de usuario, texto, gráficos, software, música y sonidos (colectivamente, el "Contenido del Juego"), son propiedad exclusiva de Dream Potion Games o de sus licenciantes. El Juego se encuentra protegido por leyes y tratados internacionales de derechos de autor y otras leyes de propiedad intelectual.

2.2. Marcas y Contenido de Terceros

Cualquier marca registrada, logotipo, diseño, o contenido de terceros que aparezca en el Juego es propiedad de sus respectivos titulares. Su inclusión en el Juego no implica la concesión de una licencia adicional ni el otorgamiento de derechos sobre dicho contenido. Está prohibido utilizar el contenido de terceros sin la autorización expresa del titular.

2.3. Contenido Generado por el Usuario

En caso de que el Juego permita la creación de contenido (como comentarios, reseñas, imágenes o cualquier otro tipo de material), usted concede a Dream Potion Games , de manera automática, una licencia perpetua, irrevocable, no exclusiva, sublicenciable, transferible, libre de regalías para utilizar, reproducir, modificar, distribuir y mostrar dicho contenido en relación con el Juego. Dream Potion Games podrá emplear cualquier contenido generado por el usuario en campañas de marketing, materiales promocionales u otras comunicaciones relacionadas con el Juego.

3. PRIVACIDAD Y PROTECCIÓN DE DATOS

3.1. Recopilación de Datos

Dream Potion Games no recopila ni almacena datos personales directamente a través del Juego. Cualquier información de compra u otro tipo de dato personal que pueda ser necesario para acceder al Juego es manejada exclusivamente por las plataformas de distribución (Google Play Store) en conformidad con sus propias políticas de privacidad y de gestión de datos.

3.2. Políticas de Terceros

El acceso y uso del Juego a través de plataformas de terceros puede estar sujeto a las políticas de privacidad y condiciones de servicio de dichas plataformas, las cuales pueden ser distintas de las de Dream Potion Games .

4. GARANTÍAS Y LIMITACIONES

4.1. Exclusión de Garantías

EL JUEGO SE PROPORCIONA "TAL CUAL" Y "SEGÚN DISPONIBILIDAD", SIN GARANTÍAS DE NINGÚN TIPO, EXPRESAS O IMPLÍCITAS, INCLUYENDO, PERO SIN LIMITARSE A, GARANTÍAS IMPLÍCITAS DE COMERCIABILIDAD, IDONEIDAD PARA UN PROPÓSITO PARTICULAR, NO INFRACCIÓN, O DISPONIBILIDAD CONTINUA DEL JUEGO.

4.2. Limitación de Responsabilidad

En la máxima medida permitida por la ley, Dream Potion Games no será responsable de daños directos, indirectos, incidentales, especiales, punitivos o consecuentes, incluidos, entre otros, la pérdida de datos, ingresos, uso, reputación o cualquier otra pérdida intangible que surja del uso o incapacidad para utilizar el Juego, incluso si Dream Potion Games ha sido advertida de la posibilidad de tales daños.

4.3. Exclusión de Garantías para el Rendimiento del Juego

Dream Potion Games no garantiza que el Juego esté exento de errores, vulnerabilidades de seguridad, interrupciones, o que funcione sin demoras. Usted reconoce que el acceso y uso del Juego puede verse interrumpido por circunstancias ajenas al control de Dream Potion Games .

5. SEGURIDAD Y ANTITRAMPAS

Dream Potion Games se reserva el derecho de implementar medidas tecnológicas de protección para garantizar la seguridad del Juego y la integridad de la experiencia de juego. Queda estrictamente prohibido el uso de software de terceros, trampas, hacks o cualquier otro método que altere o modifique la funcionalidad original del Juego. Cualquier intento de manipulación, interferencia o modificación no autorizada constituirá una violación a este EULA y dará lugar a la terminación de su licencia, sin perjuicio de las acciones legales adicionales que Dream Potion Games pueda considerar necesarias.

6. PROHIBICIÓN DE INGENIERÍA INVERSA

Queda prohibido realizar ingeniería inversa, descompilar, desensamblar o intentar descubrir el código fuente del Juego, en su totalidad o en parte. Esta disposición aplica salvo en la medida en que tales actividades estén expresamente permitidas por la ley aplicable, y solo después de notificar a Dream Potion Games por escrito sobre dichas acciones.

7. PROHIBICIÓN DE TRANSFERENCIA DE CUENTAS

Queda estrictamente prohibido vender, transferir, alquilar, sublicenciar o ceder su cuenta de usuario o derechos de uso del Juego a terceros, ya sea mediante contrato, cesión o cualquier otro medio. Cualquier intento de transferencia o disposición sin autorización expresa de Dream Potion Games constituirá una violación a este EULA y resultará en la revocación inmediata de la licencia.

8. TERMINACIÓN

8.1. Terminación del EULA

Dream Potion Games se reserva el derecho a terminar el presente EULA y su acceso al Juego en caso de que usted incumpla cualquier término o condición aquí establecido. Al finalizar este acuerdo, usted deberá eliminar permanentemente todas las copias del Juego de sus dispositivos.

8.2. Efectos de la Terminación

La terminación de este EULA no limita los derechos de Dream Potion Games a buscar cualquier remedio disponible conforme a la ley en caso de incumplimiento. Las disposiciones de Propiedad Intelectual, Limitación de Responsabilidad, Resolución de Disputas, y cualquier otra disposición que, por su naturaleza, deba permanecer vigente tras la terminación, continuarán en vigor.

9. RESOLUCIÓN DE DISPUTAS

Para cualquier controversia derivada del uso del Juego, LAS PARTES acuerdan renunciar a su derecho a emprender acciones legales ante tribunales judiciales y se someten al arbitraje en el Centro de Arbitraje y Mediación de la OMPI/WIPO , renunciando al derecho de demandas colectivas.

La elección de resolver disputas a través del Centro de Arbitraje de la OMPI/WIPO demuestra nuestro compromiso con una resolución justa, eficiente y neutral de las controversias. Valoramos la confianza que los usuarios depositan en nuestros servicios y nos esforzamos por mantener una relación transparente y colaborativa en caso de cualquier conflicto.

El laudo arbitral será vinculante y definitivo.

10. MODIFICACIONES AL EULA

Dream Potion Games se reserva el derecho de modificar los términos de este EULA en cualquier momento. Las modificaciones se notificarán a través de una publicación en el sitio web oficial de Dream Potion Games o mediante el propio Juego. Su uso continuado del Juego constituye su aceptación de las modificaciones introducidas.

11. DIVISIBILIDAD

Si alguna disposición de este EULA se considera ilegal, nula o inaplicable, dicha disposición se limitará o eliminará en la medida mínima necesaria para cumplir con la ley aplicable, y las disposiciones restantes permanecerán en plena vigencia y efecto.
